Terms for using aQRify

Introduction

These Terms & Conditions govern your access to and use of aQRify, including our website, QR code generator, account dashboard, QR code customization tools, dynamic redirect features, analytics, and related services.

By creating an account, signing in with Google, generating QR codes, saving QR codes to a workspace, or otherwise using aQRify, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

We may update these Terms as aQRify changes. If a change materially affects your rights or obligations, we will make reasonable efforts to provide notice by email, in-product notice, or an updated notice on this page.

Class Action Waiver

BY USING AQRIFY, YOU AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL BE RESOLVED INDIVIDUALLY, ON YOUR OWN BEHALF ONLY. YOU WAIVE ANY RIGHT TO BRING, JOIN, OR PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, MASS ARBITRATION, PRIVATE ATTORNEY GENERAL, OR SIMILAR PROCEEDING AGAINST AQRIFY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

YOU ALSO WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE BETWEEN YOU AND AQRIFY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

THIS SECTION IS A MATERIAL PART OF THESE TERMS. IF A COURT FINDS THIS WAIVER UNENFORCEABLE IN A PARTICULAR JURISDICTION OR FOR A PARTICULAR DISPUTE, THE REMAINDER OF THESE TERMS WILL REMAIN IN EFFECT. IN THAT CASE, THE DISPUTE MUST STILL BE RESOLVED ON AN INDIVIDUAL BASIS WHEREVER APPLICABLE LAW PERMITS.

About aQRify

aQRify helps users create, customize, download, manage, and track QR codes. Some QR codes may be static, meaning the encoded destination cannot be changed after download. Other QR codes may be dynamic, meaning the destination may be updated through aQRify while the visible QR code remains the same.

aQRify is intended for general business, marketing, operational, educational, and personal use. It is not designed for emergency response, medical decision-making, safety-critical systems, high-risk financial authorization, critical infrastructure, or any situation where QR code failure, incorrect routing, or delayed availability could cause harm.

We may add, modify, limit, suspend, or discontinue features as the product evolves. Availability of specific features may depend on your account type, plan, beta access, technical limits, or legal requirements.

Eligibility and Accounts

You must be at least 18 years old, or the age of majority where you live, to create a aQRify account. If you use aQRify on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for providing accurate account information, maintaining the security of your email account and password, and promptly notifying us if you suspect unauthorized access.

We may refuse registration, require email verification, suspend access, or close accounts that appear fraudulent, abusive, compromised, duplicative, or otherwise in violation of these Terms.

Email Verification, Google Sign-In, and Security

Email/password accounts must verify their email address before the account becomes active. Google sign-in accounts may be treated as verified when Google confirms the email address.

Password reset links, verification links, and session cookies are sensitive. Do not share them. You are responsible for activity under your account until you notify us of suspected compromise.

For security, aQRify may automatically sign you out after inactivity and may ask whether you want to stay logged in before ending a session.

Your QR Codes and Content

You retain ownership of the destination URLs, text, files, logos, brand assets, labels, and other content you provide to aQRify. You grant aQRify a limited, worldwide, non-exclusive license to host, store, process, display, transmit, reproduce, and use that content only as needed to provide, secure, maintain, and improve the service.

You are responsible for every QR code you create, every destination it points to, and every logo, image, or other asset you upload. Only upload or use logos and brand assets that you own or are authorized to use.

aQRify does not imply endorsement, partnership, sponsorship, or affiliation with third-party brands, platforms, or logos that users may reference or upload.

Prohibited Uses

You may not use aQRify to create, host, redirect to, distribute, or promote illegal, deceptive, harmful, infringing, abusive, or unsafe content.

Prohibited uses include phishing, malware, credential theft, fraud, impersonation, spam, link cloaking for abuse, unauthorized tracking, sale of unlawful goods or services, harassment, hate speech, exploitation of minors, non-consensual intimate content, or content that encourages violence, self-harm, terrorism, or other serious harm.

You may not probe, scan, attack, overload, scrape, reverse engineer, bypass rate limits, resell aQRify infrastructure as a generic redirect service, or interfere with other users or the reliability of the platform.

QR Code Reliability and Third-Party Destinations

QR code readability depends on design choices, printing quality, scanner software, device cameras, lighting, network conditions, and the destination service. aQRify provides readability guidance, but we do not guarantee that every QR code will scan in every environment.

Dynamic QR codes may redirect users to third-party destinations selected by the account holder. aQRify does not control, verify, endorse, or guarantee third-party websites, products, services, content, availability, privacy practices, or security.

You are responsible for testing QR codes before publishing, printing, distributing, or relying on them.

Plans, Billing, and Future Paid Features

aQRify may offer free, trial, paid, subscription, usage-based, or add-on features. Prices, plan limits, renewal terms, and billing details will be shown before purchase when paid plans are available.

Unless otherwise stated at checkout, paid subscriptions may renew automatically until canceled. You are responsible for applicable taxes and for keeping payment information accurate.

Payments, refunds, credits, cancellations, and plan changes will be handled according to the terms shown at checkout or in your account settings. If there is a billing issue, contact support promptly with your account email and relevant payment details.

Fair Use and Service Limits

We may apply reasonable technical and fair-use limits to protect aQRify and keep the service reliable. Limits may relate to QR code creation, scan volume, analytics retention, file size, API requests, upload activity, or bulk operations.

We may monitor platform usage to detect abuse, fraud, performance issues, security threats, and violations of these Terms.

If usage threatens the stability, security, legality, or availability of aQRify, we may throttle, restrict, suspend, or terminate access.

Platform Ownership

aQRify and its software, interface, designs, code, documentation, systems, workflows, trademarks, trade dress, and related intellectual property are owned by aQRify or its licensors.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use aQRify for its intended purpose while your account remains active and in good standing.

You may not copy, resell, sublicense, reverse engineer, decompile, modify, or use aQRify to build or train a competing product except where applicable law expressly permits.

Privacy and Analytics

Our Privacy Policy explains how we collect, use, retain, and protect personal information and QR analytics data.

Depending on the features you use, aQRify may process account information, QR destinations, scan events, device or browser metadata, approximate location signals, and operational logs.

If you use aQRify for your own customers, visitors, employees, or end users, you are responsible for providing any required notices and obtaining any required consents for your use case.

Enforcement and Account Closure

We may investigate suspected misuse, remove or disable QR codes, restrict features, suspend accounts, terminate accounts, preserve evidence, and cooperate with law enforcement or rights holders when we reasonably believe it is necessary.

You may stop using aQRify at any time. If account deletion or export tools are available, you may use them from your account settings. Some records may be retained as required for security, legal compliance, dispute resolution, backups, fraud prevention, and legitimate business records.

Sections that by their nature should survive termination will continue to apply, including content responsibility, intellectual property, disclaimers, limitations of liability, indemnity, and dispute terms.

Disclaimers

aQRify is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, and error-free operation.

We do not guarantee that QR codes will always scan, redirects will always be available, analytics will be complete or perfectly accurate, third-party destinations will be safe, or defects will be corrected on a specific timeline.

No advice or information, whether oral or written, creates a warranty unless expressly stated in these Terms.

Limitation of Liability

To the maximum extent permitted by law, aQRify will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, or the cost of substitute services.

To the maximum extent permitted by law, our total liability for all claims relating to aQRify or these Terms will not exceed the amount you paid to aQRify in the 12 months before the event giving rise to the claim, or 100 USD if you have not paid us.

Some jurisdictions do not allow certain exclusions or limitations. In those places, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold aQRify and its owners, employees, contractors, service providers, and affiliates harmless from claims, damages, losses, liabilities, costs, and expenses arising from your use of aQRify, your QR codes, your destinations, your content, your violation of these Terms, your violation of law, or your infringement of third-party rights.

We may control the defense of any claim subject to indemnification, and you agree to cooperate with us.

Disputes

Before starting a formal dispute, you agree to contact us and give us a reasonable opportunity to resolve the issue informally.

To the extent permitted by law, disputes must be handled individually and not as a class, collective, consolidated, private attorney general, or representative action.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, unless mandatory law in your jurisdiction requires otherwise.

General Terms

These Terms, together with the Privacy Policy and any plan or checkout terms presented to you, form the entire agreement between you and aQRify regarding the service.

If any part of these Terms is found unenforceable, the remaining parts will remain in effect. Our failure to enforce a term does not waive our right to enforce it later.

You may not assign these Terms without our permission. We may assign them in connection with a merger, acquisition, corporate reorganization, or sale of assets.
